By accessing or using WhatSched (the "Service"), operated by Safari Technologies Pte. Ltd. ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

WhatSched is a message scheduling service that allows you to connect your WhatsApp account and schedule messages to be sent at specified times. The Service operates by maintaining a connection to WhatsApp Web on your behalf and delivering messages according to your schedule.

3. Eligibility

You must be at least 13 years old to use this Service. By using WhatSched, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Only send messages to recipients who have consented to receive communications from you
• Comply with all applicable laws and regulations regarding electronic communications
• Not use the Service to send spam, unsolicited messages, or harass others
• Maintain the security of your WhatsApp account and session
• Accept responsibility for all messages sent through your connected WhatsApp account

5. WhatsApp Compliance

Your use of WhatSched is also subject to WhatsApp's Terms of Service and acceptable use policies. You acknowledge that:

• WhatsApp may limit, suspend, or terminate your WhatsApp account for violations of their policies
• We are not affiliated with WhatsApp or Meta and cannot guarantee uninterrupted WhatsApp service
• You are responsible for ensuring your use of WhatSched complies with WhatsApp's terms
• Automated or bulk messaging may violate WhatsApp's terms and result in account restrictions

6. Prohibited Uses

You may not use the Service to:

• Send spam, bulk unsolicited messages, or promotional content without consent
• Harass, threaten, or intimidate any person
• Send illegal, harmful, or offensive content
• Impersonate any person or entity
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems or other users' data
• Interfere with or disrupt the Service or servers
• Use the Service for any commercial mass-messaging purposes without our prior written consent

7. Service Availability

We strive to provide reliable service but do not guarantee that the Service will be available at all times or that messages will be delivered at the exact scheduled time. The Service may be interrupted for maintenance, updates, or circumstances beyond our control. We are not liable for any failed or delayed message deliveries.

8. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by Safari Technologies Pte. Ltd. and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

9. Paid Services

We may offer paid features or subscription plans in the future. If you purchase paid services, additional terms regarding payment, billing, and refunds will apply and will be presented to you at the time of purchase.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFARI TECHNOLOGIES PTE. LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless Safari Technologies Pte. Ltd. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time by disconnecting your WhatsApp account and clearing your browser session. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Singapore.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
